U.S. Federal Motor Carrier Safety Administration (FMCSA) Moves Towards Rulemaking on Broker Transaction Records

Late last month, the FMCSA indicated in a response letter to an Owner-Operator Independent Drivers Association (OOIDA) petition, that the agency found merit to begin a rulemaking that may result in brokers being required to provide information to  motor carriers. The OOIDA request is that motor carriers provide an automatic electronic copy of transaction records, within 48 hours after delivery. 

 

This issue is not without sides across the transportation industry, with some of the transaction information requested in the petition being proprietary or confidential in nature from the broker's perspective. This is an issue IAM will continue to carefully follow, and engage on as appropriate when the formal rulemaking and connected comment period begins. The FMCSA has not yet provided a timeline for the rulemaking process.
