U.S. Dept. of Homeland Security Approves Issuance of an Additional 22,000 H-2B Visas

Visas would be for the Second Half of FY 2021 (April 1 - Sept. 30)

IAM has been following this issue closely, as the domestic household goods moving industry frequently utilizes this critical temporary workforce program, particularly during the peak moving season. In its announcement, DHS reminded applicants that employers seeking H-2B workers must first test the U.S. labor market, and certify in their petitions that there are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work for which they seek a prospective foreign worker.

In addition, the visas will only be made available to employers that are willing to attest that, if they do not receive workers under the cap increase, they are likely to suffer irreparable harm. DHS will issue a temporary final rule (likely next month), which will provide additional information on the visa process, and specific approval requirements. IAM will provide that information to members when issued.
